References to Elixir Travel, 'we', 'our', and 'us' are to Elixir Travel Consulting Limited, and references to 'you' and 'your' are to you the client.
ITINERARY AND RETAINER
We are a travel consultancy in its purest sense, creating experiences that meet your wants and needs.
After initial consultations through our website, by telephone and by email, you may choose to retain Elixir Travel to create an itinerary for you that will detail all the accommodation, internal transfers, vehicle rentals, activities, guiding and other services (as meet your wants and needs) to be provided, arranged or managed by Elixir Travel during your stay in New Zealand.
The itinerary will give a detailed breakdown of costs involved, including the total cost to be paid by you for that itinerary. The itinerary prepared can be changed, amended or altered in any way at your request prior to booking at no additional cost to you.
A consultancy retainer is payable to Elixir Travel on retaining us to create an itinerary for you, and its calculation is based on the proposed number of days you will spend in New Zealand.
Unlike many other travel consultancies, the reason we charge a consultancy retainer, and provide a breakdown of the costs involved, is to maintain transparency.
Rather than quote you an all-in cost and build an unstated premium for our services into that figure, you will see from the cost breakdown that you are paying the same rate for a room or activity as you would if you booked it yourself.
This transparency allows you to see where and how your money is being spent.
Our retainer places a tangible value on the expertise we are providing, goes some way to covering the considerable communication, labour and sundry expenses incurred in the creation of an itinerary, and protects us from clients who would take the itinerary and make all the bookings privately, thus saving themselves the aforementioned premium.
Our retainer amounts to $NZ95 per proposed day, becomes payable upon your retention of our consultancy services, and are due at the time the deposit for your trip is taken. So, for example, if the proposed length of your vacation within New Zealand is 14 days, our consultancy fees will be $NZ1,330. We will require your credit card details prior to the creation of an itinerary to guarantee those fees.
Any change, amendment or alteration to your itinerary made at your request after booking may by subject to further costs. These include, but are not limited to, a difference in the total cost quoted by Elixir Travel, or a service charge to cover the costs involved in making the amendment. Elixir Travel will notify you as soon as practicable in the event of any further costs payable.
BOOKING
Bookings for any accommodation, vehicle rentals, transfers, activities and guides will be secured through the payment of a non-refundable deposit in accordance with our Payment terms.
When we have received payment of your deposit and retainer fees, a finalized daily planner will be emailed to you. Should you require hard copies prior to arrival, an additional courier's fee of $NZ60 will be added to your invoice.
PAYMENT
You will pay to Elixir Travel a non-refundable deposit of 25% of the total price for your itinerary within seven [7] days of confirming your itinerary. Failure to pay this deposit within the seven [7] days may result in the cancellation of your itinerary by Elixir Travel. Your booking with Elixir Travel is complete upon receipt by us of this deposit.
Full and final payment of the balance of the total price payable in accordance with your itinerary must be paid to Elixir Travel no later than sixty [60] days prior to day one of your itinerary. Elixir Travel shall have the right to cancel your booking if full and final payment is not received by this date.
In the event you confirm your itinerary within sixty [60] days of day one of your itinerary, you will pay to Elixir Travel the total price payable in accordance with your itinerary within seven [7] days of confirmation.
Any further costs that you may be required to pay to Elixir Travel, including, but not limited to, any costs payable as a result of any change, amendment or alteration to your itinerary, are to be paid within seven [7] days of notification received from Elixir Travel.

PRICE
Elixir Travel will quote the total price payable for each itinerary at the time of presentation to you. The price quoted will only be in respect of the accommodation, transfers, activities, meals, guiding and other services to be provided, arranged or managed by Elixir Travel as detailed in your itinerary. Elixir Travel may alter the total price payable at any time in its sole and absolute discretion.
All prices quoted by Elixir Travel are in New Zealand Dollars (NZ$) unless otherwise indicated, are inclusive of New Zealand Goods and Services Tax (GST) chargeable in accordance with the Goods and Services Tax Act 1985, and are subject to any increase in GST by the New Zealand government.
All fees are in New Zealand Dollars, and are inclusive of Government Goods and Service Tax (GST) of 12.5%. They are subject to any increases in GST by the New Zealand Government.
CANCELLATION
It is recommended that you purchase travel insurance.
This is to cover you should you need to cancel your trip or make any emergency arrangements during your holiday.
In the event you cancel your booking with Elixir Travel you will be subject to certain costs.
You agree and acknowledge that immediately upon cancellation of your booking at any time your deposit of 25% shall be forfeited.
In the event you cancel your booking within sixty [60] days of day one of your itinerary you will forfeit the following portion of the total price paid to Elixir Travel in accordance with your itinerary:
30 days or less before day one of your itinerary: 100%
If adverse weather means that you are unable to complete an activity then you will receive a full refund at the completion of your trip.
If a guided Milford Track or Routeburn Track booking is included in your trip arrangements, as per track policy, there is a $NZ200 per person cancellation policy and no refund if cancelled within sixty [60] days of the hike's commencement.
Elixir Travel will refund to you the balance of the total price paid not forfeited in accordance with these Cancellation terms within twenty [20] days of receiving notification of your cancellation.
REFUND
Elixir Travel will not refund to you any monies paid in respect of your itinerary once your itinerary has commenced.
Elixir Travel will not refund to you any monies in respect of any tours, accommodation, activities or other services included in your itinerary that you have not used for any reason.
ADDITIONAL EXPENSES
The price only includes the accommodation, transfers, activities, meals, guiding and other services that are to be provided, arranged or managed by Elixir Travel. Certain additional expenses may be incurred and will be your sole responsibility.
International and New Zealand departure taxes, customs and any immigration fees and visas that you may require are not included in the price.
Items of a personal nature are not included in the price. These include, but are not limited to: any additional activities, meals, beverages and the like not detailed in your itinerary, pre-registration or late check out of rooms, laundry, phone calls, tipping and room service. In the event you elect to self-drive, any running costs and insurance excess associated with the rental vehicle are not included in the price.
INDEPENDENT ARRANGEMENTS
You may at anytime make your own arrangements that are in addition to, or different from, your itinerary prepared by Elixir Travel. Any such arrangements will be made entirely at your own risk and your rights will lie solely against the organizations supplying or providing such arrangements.
ACCOMMODATION
All accommodation in your itinerary will be based on "Run of House" rooms, unless specifically mentioned otherwise. Elixir Travel has no control over which room may be allocated to you by the accommodation provider.
ELIXIR TRAVEL CONSULTING
Elixir Travel may, in its sole and absolute discretion, change, amend, alter your itinerary at any time after your itinerary is confirmed Elixir Travel may further substitute any service provider detailed in your itinerary for another of a similar or higher standard after your itinerary is confirmed. Elixir Travel shall notify you as soon as practicable in the event of any such change, amendment, alteration or substitution. You agree and acknowledge that any costs payable as a result of any change, amendment, alteration or substitution to your itinerary, are to be paid by you in accordance with the payment terms.
DISCLAIMER
Elixir Travel offers creation, management and support services for your vacation in New Zealand. We undertake to perform these services with reasonable skill and care. Elixir Travel acts at all times as your agent to introduce you to the service providers included in your itinerary. We do not own or operate the accommodation, transport, activities or other services included in this website or that may be included in your itinerary. Elixir Travel does not accept any responsibility or liability of any nature for any acts, omissions, defaults or failures, whether negligent or otherwise, on the part of those service providers.
We do not accept any liability for personal injury, death, delay, loss of any nature, property damage, inconvenience or additional expenses, resulting from acts, omission or negligence whatsoever of Elixir Travel, its agents, contractors or any other service providers or operators, including, but not limited to, any liability arising from delayed departure, missed carrier connections, substitutions of accommodation or transportation, termination of service, changes in price, cancellation or double bookings of reservations, or the failure of any service provider at any time. Elixir Travel does not accept any liability for any changes to, or cancellation of, your itinerary for health or safety reasons.
Elixir Travel does not at any time accept any liability in relation to your failure to obtain the correct and required documentation for travel in and to New Zealand (including, but not limited to, passports, visas and health certificates). Further, Elixir Travel does not accept any liability in relation to your failure to obtain travel insurance, follow instructions (including but not limited to check in, check out and departure places and times) or the delay or loss of, or damage to, your luggage or its contents. On booking with Elixir Travel you are deemed to warrant that you maintain a reasonable standard of fitness and health as may be required to participate in your itinerary. In the event you will require medical and/or physical assistance you must be accompanied by a companion. Elixir Travel, its suppliers, agents and contractors do not provide this service.
FORCE MAJUERE
Elixir Travel will be not responsible or liable for any damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events which are beyond our control, including, but not limited to: war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, acts of God, acts, demands, orders or requirements of any government, government agency or other authorities, technical problems affecting transport or any other circumstances amounting to force majuere events beyond our control.
APPLICABLE LAW
Elixir Travel terms and conditions are governed by, and construed and interpreted in accordance with the laws of New Zealand and shall be subject to the exclusive jurisdiction of the New Zealand Courts.
GENERAL
Elixir Travel may amend or vary these terms and conditions at any time. Any amendments will be effective immediately when posted on our website.
If any provision of these terms and conditions is held by a competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and conditions and the remainder of the provisions in question shall not be affected.
Any heading used in these terms and conditions is for ease of reference only, and shall not affect the interpretation or construction of these terms and conditions.

This is the entire agreement between the parties relating to the subject matter herein and shall not be modified except by an agreement in writing signed by Elixir Travel Consulting Limited.
Relationship With Other Parties
Unless otherwise stated, Elixir Travel is not an agent or representative of any third party and has not authorized any third party to act on its behalf.
